Please read these Terms of Sale carefully before you order products from Lexy Hong Kong official online store.

applicability

The reason you are reading these Terms of Sale ("Terms of Sale") is because you are using Lexy Hong Kong official online store ("Lexy Hong Kong official website"), digital experience, social media platform, mobile application, wearable technology or one of our Other products or services (if applicable), the aforementioned products and services are all components of the Lexy platform ("Platform"). These Terms of Sale form a legally binding agreement between you and KDI Trading Ltd and its affiliates (we will refer to them as "Lexy", "we" or "our") for the sale of products. Lexy may modify the Terms of Sale and publish them on the Platform without notification. When you place an order on the Platform, the terms of sale published on the Platform at that time will apply to that purchase. Please read these terms carefully and check that your order details are complete and accurate before submitting your order. If you think there is an error, please contact us . Lexy's Terms of Service and Privacy Policy are incorporated by reference into these Terms of Sale.

Order on the platform

Ordering qualifications

To place an order on the platform, you must be of legal age as stipulated by Hong Kong law and be a consumer, not a dealer.

Resale prohibited

The platform is only for Lexy to sell Lexy products and other brand products directly to end consumers, so purchasing products for resale is strictly prohibited. Resale refers to the act of selling or offering to sell Lexy products to others (consumers, businesses or any third parties). Lexy reserves the right to take any action against you, including but not limited to restricting the sale of products to you, if Lexy has reasonable grounds to believe that your purchase may be for resale and that you have breached the Contract (as defined below) and/or these Terms of Sale. , cancel your order, prohibit you from using a certain credit card and/or suspend or close your account.

How to order

You need a real and valid email address to place an order, and you may need to set your browser to accept (functional) cookies and pop-ups in order to be able to use all features of the platform, including designing customized products (if applicable) , add the product to your cart and submit your order. After you submit your order, we will send you an email confirming receipt of the order and a payment receipt (if applicable). We will confirm our acceptance of your order by sending you an order confirmation notification ("Order Confirmation"). At this time, a contract incorporating these Terms of Sale (the "Contract") is formed and binding on you and us. We recommend that you print or download these Terms of Sale and the associated order confirmation for future reference. If we are unable to supply the Products to you, we will notify you and the order will no longer be processed.

Our right to refuse your order or terminate the contract

The fulfillment of all orders on the platform is subject to product inventory availability. We expressly reserve the right to refuse to accept your order for any reason. We also reserve the right to terminate the contract under the following circumstances, and we will not be liable for any damages or expenses other than a full refund to you:
  • Product out of stock/out of stock;
  • Your order information is incorrect or unverifiable;
  • Your order is marked as an abnormal order by our security system;
  • We did not receive your bank transfer payment within the specified payment time limit after we received your order (the payment time limit is subject to the actual situation displayed on Lexy Hong Kong's official website or Lexy reminds the guest of the payment time limit);
  • We have reasonable grounds to believe that you are under the legal age under Hong Kong law;
  • We have reasonable grounds to believe that you are purchasing the product for resale purposes;
  • The price displayed on the platform is incorrect;
  • We are unable to deliver to the address you provided;
  • Due to events outside our control (as defined below);
  • There are spelling errors, pricing errors or other errors or mistakes in the platform information.

Data check

When you submit your order to us, you agree that we may conduct such inspections as we deem reasonable. These checks may include verifying your address and checking for fraud. We will investigate suspected fraud and reserve the right to take further action.

Risk of loss and title for products purchased from Lexy pass to you upon our delivery of the products to the carrier.

Price/Payment

Payment method

You can find the payment methods you can use on the payment instructions page of Lexy Hong Kong's official website. We do not accept any other payment methods other than those listed on the Payment Instructions page. Please do not try to pay by other methods. If you do this, we will not be liable for any loss of payment or any other damage that may result from this action.

If you pay using a credit/debit card, we will deduct the amount due from your account. If you pay by bank transfer (only applicable to special orders or where we have agreed otherwise with you), we will start shipping after receiving your payment. This may take a few days (does not apply to custom design orders or special orders where we have agreed otherwise with you). If we do not receive payment within the specified payment time limit after you submit the order, your purchase will be automatically canceled (the payment time limit is subject to the actual situation displayed on the Lexy Hong Kong official website or Lexy reminds the guest of the payment time limit). We will only process payments if we can verify billing information.

prices and currencies

Product prices displayed on the counter are quoted in Hong Kong dollars and include Value Added Tax (VAT), where applicable. Shipping charges for individual orders are calculated individually. For shipping details, please see the website's logistics policies page.

total price

The total price listed on the final checkout screen includes shipping charges. This price will be recorded on the order confirmation, we recommend that you print or download the order confirmation for future reference. If paying by credit card, the total amount of your entire order will be reflected on your bill in the currency of your choice.

If your local currency is different from Hong Kong dollars, your bank will apply the exchange rate on the day of purchase. Your bank may also use a different exchange rate, which is beyond our control.

Cash on delivery (COD)

If you choose the "Cash on Delivery" payment method, the order amount on the shipping confirmation must be paid in full in Hong Kong dollars before you receive your item and sign the delivery order before you can open the package and inspect the item. The "Cash on Delivery" amount is collected by SF Express, and the order amount will be calculated by rounding it to an integer.

Price changes

The price of the product will be the price displayed on the platform. Prices may change from time to time, but such changes will not affect any orders we have confirmed in our order confirmation.

Shipping and delivery

Delivery - when and where

We will not ship on certain public holidays. Please refer to the relevant page information on the website for delivery dates, times and methods. Only home addresses, office addresses or shipping addresses provided by designated third-party partners in the areas listed on the logistics policy page of this website can be used as delivery addresses to complete order delivery.

Delivery in batches

Where possible we try to deliver all items you order at the same time. However, since products may be shipped from different distribution centers, the same order may be shipped in batches.

We reserve the right to split an order for delivery if, for example, part of the ordered product is delayed or out of stock. If we split your order, we will notify you of this via the email address you provided when ordering. You will not be charged any additional shipping fees.

If your purchase exceeds the free shipping threshold, you will receive free "standard shipping" or the right to choose discounted "express delivery" (if applicable). Meeting other criteria may also qualify you for free shipping. Returns and cancellations

Cancel and change orders before shipping

You can cancel or change any order for free without reason before shipment (does not apply to pre-orders, design custom orders, or special orders otherwise agreed between us and you). If you want to cancel your order, please contact us first to check the order status. If your order status is "Pending Payment" or "Order Confirmed", you can cancel the order by contacting us and it will be arranged to be returned with a Lexy e-gift card (please refer to the payment instructions page of this website). Our customer service specialists will ask our warehouse to cancel your order. If the cancellation is successful, they will send you an email and the cancellation will be free of charge. If the product has been shipped, the order cannot be cancelled, the product will be delivered to you and you have the right to return it in accordance with the returns procedures and conditions below.

Return after delivery - product description issue

If you receive a product that does not match your order, you have the right to return it. This does not affect your statutory rights. If your claim is legitimate, we will take back the products that do not match your order, confirm that the returned products are brand new and unopened and retain complete packaging to the level of resale, and resend the correct products; If the product is out of stock, it will be fully refunded with an e-gift card of equal value issued by our store. Please see the website's refund policy page for useful information on how to return items.

If the product you purchased meets the return standards announced on the Lexy Hong Kong official website, you can return or exchange the product within 30 days from the date of receipt of the product (based on the order confirmation date) and within the product maintenance scope, if applicable. . (Except for activities/products below). Returns and exchanges are currently accepted for Macau and overseas orders. Return and exchange fees may include but are not limited to: freight, tariffs, customs declaration fees, etc. These fees will be paid by the customer. All additional charges will be charged in full before reshipping.

The following activities/products are excluded:
  • The return deadlines for priority access and designated special edition products will be different. Please refer to individual event details for details.
  • Returns must comply with Lexy's return and exchange standards and procedures. Three days after the receipt date shown by the third-party logistics provider, you will be deemed to agree that the product has no appearance defects and that all accessories are complete. After the purchase is completed, you will not be able to return or exchange the product except for original product quality issues.
  • Some special products related to personal hygiene and health (such as underwear, etc.) do not support returns or exchanges except for product quality issues. Please refer to the information on the actual product page. Lexy has the final say.
  • Gift cards are not eligible for returns. For more information, please see our Lexy Gift Card Terms and Conditions.
  • For orders placed under certain offers/promotions, if you need to apply for a return, you must return all the products in the order. Partial returns and refunds are not accepted. Please refer to individual event details for details.
  • If Lexy determines, in its reasonable judgment, that the returned product is not an original Lexy product, Lexy will not issue a refund but will retain the returned product as evidence. Lexy reserves all legal rights in this regard.
  • Refund information

    Generally, the refund will be refunded in Lexy e-gift card. In individual cases (only applicable to special orders or where we have agreed otherwise with you) the refund will be refunded in the original way. You may need to provide us with necessary information so that we can refund the money to you. Please see the website's refund policy page for practical information on how to return items and the refund schedule.

    events beyond our control

    Events Outside Our Control means any act or event beyond our reasonable control including, but not limited to, strikes, lockouts or other industrial action by third parties, riots, riots, invasions, terrorist attacks or threats of terrorist attacks, war (whether declared or undeclared) or threat of war or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks.

    If the occurrence of events beyond our control affects the performance of our obligations under these Terms of Sale:

    a) We will notify you as soon as reasonably possible; b) Our obligations under the General Conditions will be suspended and the time for performance of our obligations will be extended accordingly. If an event outside our control affects our delivery of the Products to you, we will arrange a new delivery date after the event outside our control has ended. If an event outside of our control occurs and you no longer wish us to supply the products, you can end the contract. Your cancellation rights are set out in the cancellation terms above.

    Other important terms

    We may transfer our rights and obligations under the Contract to another organization but this will not affect your rights or obligations under these Terms of Sale.

    You may only transfer your rights or obligations under these Terms of Sale to another person with our written consent.

    These are Lexy's terms of sale. Please do not use them without our express written consent. Lexy reserves all legal rights in this matter.
